- Agreement: by accessing or using the website (“www.thetrailerguys.uk”), users agree” to be bound by these Terms and Conditions and the Privacy Policy.
- Updates: Reserve the right to update or change the T&Cs at any time, and state how users will be notified (e.g., email or a notice on the site).
- Minimum Age: Minimum age required to use the service is 18 years old.
1.1. User Accounts
- Registration: We requirement users to create an account to use this website, and keep your profile upto date (e.g., providing accurate, complete, and current information).
- Account Security: Users are responsible for maintaining the confidentiality of their password and for all activities under their account. “We” are not liable for any loss or damage arising from a user’s failure to protect their password.
- Termination: “We” reserve the right to suspend or terminate any account without notice for a breach of these T&Cs.
1.2. Advertising and Content Guidelines
- User Content: Define all information, text, photos, and materials posted by users as “User Content.” Users retain ownership of their content but grant “us” a license to use it on this website.
- Accuracy of Listings: Users must ensure that all listings (for selling or hiring trailers) are accurate, truthful, and comply with all applicable laws. The advertised trailer must exist and be available.
- Prohibited Content/Items: List content that is strictly forbidden, such as:
- Illegal, fraudulent, or stolen goods.
- Hate speech, obscenity, or defamatory material.
- Content that infringes on any third party’s intellectual property rights.
- Content that promotes pyramid schemes or phishing.
- Vetting and Removal: “We” reserve the right, but have no obligation, to review, edit, or remove any content or listing that violates these T&Cs.
1.4. Role of the Platform (The Marketplace Clause)
- Platform Only: “Our” website is a venue/platform only for users to connect. “We” are not involved in the actual transaction between the buyer/hirer and the seller/company. Unless you are responding to “our” listings on “our” store. (TheTrailerGuys)
- No Guarantee: “We” make no representations or warranties about the quality, safety, legality, or suitability of any trailers or businesses advertised.
- Risk: Users agree to use the Service and enter into transactions at their own risk.
- Disputes: “We” not responsible for resolving disputes between users. Users must resolve disputes directly.
1.5. Fees and Payment
- Fees: All fees (e.g., listing fees, featured ad fees, subscription fees for companies) are clearly displayed on “our” site.
- Payment Terms: Payment currently are made via Stipe and are not recurring. Once a payment duration has ended, you will need to manually renew.
- Refunds: We operate a No-Refund Policy for listing fees.
1.6. Intellectual Property
- Our IP: All content you create (logos, website design, code, graphics) is “our” intellectual property and is protected by copyright.
- User License: Users are granted a limited, non-exclusive, non-transferable license to use the Service solely for personal or internal business purposes, subject to these T&Cs.
1.7. Limitation of Liability and Indemnity
- Disclaimer of Warranties: “Our” service is provided “as is” and “as available” without any warranties, express or implied.
- Limitation of Liability: “We” are not liable for any indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use the service, even if you have been advised of the possibility of such damages.
- Indemnification: Users agree to defend and hold you harmless from any claims, damages, liabilities, and expenses (including legal fees) arising from their use of the Service, their User Content, or their violation of these T&Cs.
2. Terms for Sales Listings (Trailers, Parts, and Accessories)
This section governs the listing, sale, and purchase of any item offered on the Service under the “Sales” category, which includes trailers, equipment, parts, and related accessories.
2.1. Seller Obligations and Warranties
When you list an item for sale (the “Seller“), you agree and warrant that:
- Ownership and Authority: You are the legal owner of the listed item or have the express legal authority to sell it. The item is free of all liens, charges, or encumbrances, unless explicitly disclosed in the listing.
- Accuracy: All information provided in the listing—including the price, condition, age, specifications, images, and location—is accurate, complete, and truthful. Photos must accurately represent the current condition of the exact item for sale.
- Compliance: The listing and sale of the item complies with all applicable local, national, and international laws, including consumer protection regulations and trade standards.
- “As Is” Sale: Unless you explicitly state a written warranty in the listing, all items are offered on an “as is, where is” basis. It is the Buyer’s responsibility to conduct all necessary checks before purchase.
- Removal: You agree to promptly remove any listing immediately upon the item being sold, withdrawn, or no longer available.
2.2. Buyer Responsibilities and Due Diligence
When you respond to a Sales listing (the “Buyer“), you acknowledge and agree that:
- Risk: You accept full responsibility for all risks associated with viewing, inspecting, purchasing, and transporting any listed item.
- Verification: You are solely responsible for conducting all necessary due diligence before committing to purchase, which includes:
- Physically inspecting the item.
- Verifying the seller’s identity and ownership documentation (e.g., title, registration, VIN/HPI checks).
- Confirming the item meets your requirements and safety standards.
- Payment and Transfer: All payment arrangements, negotiation of the final sale price, transfer of funds, and assumption of legal ownership and insurance are handled directly between you and the Seller, entirely off-platform.
- No Recourse to Us: You will have no claim against TheTrailerGuys.uk arising from any transaction, misrepresentation, or defect in the item purchased.
2.3. The Sale Transaction
- Separate Contract: The decision to purchase or sell, and the terms of the sale (including final price, warranty, delivery, and payment terms), form a separate and legally binding contract solely between the Buyer and the Seller.
- No Involvement: “We” do not handle payments, deliveries, escrow services, inspections, or warranties. “We” will not act as an intermediary or arbitration body in the event of a dispute between a Buyer and a Seller.
- Fraudulent Activity: You agree to report any suspected fraudulent activity or illegal listings to us immediately, although we make no guarantee of action beyond content removal or account suspension.
3. Terms for Hire Listings (Trailer Rental and Equipment)
This section governs all listings and transactions related to the temporary rental or hire of trailers, equipment, or accessories advertised on the Service.
3.1. Lessor Obligations and Equipment Standard
When you list an item for hire (the “Lessor“), you warrant that:
- Roadworthiness and Safety: The item is maintained in a safe, roadworthy, and fit-for-purpose condition for the duration of the advertised hire period and complies with all relevant local transportation and safety regulations.
- Insurance: You hold adequate and appropriate commercial insurance (or other relevant coverage) for the item being offered for hire.
- Accuracy: The listing accurately details the item, the required rental rates, the full hire period terms, any specific usage restrictions, and all required security deposits or damage waivers.
- Ownership and Authority: You are the legal owner of the item or have the full legal right to enter into a rental agreement for it.
3.2. Hirer Obligations and Liability
When you respond to a Hire listing (the “Hirer“), you warrant and agree that:
- Verification: You are solely responsible for verifying the Lessor’s terms, inspecting the item prior to taking possession, and ensuring the item is suitable for your intended use.
- Insurance and Towing: You have the necessary licenses, appropriate tow vehicle capacity, and adequate insurance coverage to legally and safely tow and use the item during the entire rental period.
- Care of Equipment: You will treat the item with reasonable care, use it only for its intended purpose, and return it to the Lessor in the same condition as received (fair wear and tear excepted).
- Damage and Loss: You acknowledge that liability for any damage, loss, or theft that occurs during the rental period, up until the item is returned to the Lessor, rests with you, the Hirer, in accordance with the specific rental contract established with the Lessor.
3.3. The Rental Contract and Financials
- Separate Agreement: The agreement to hire a trailer, including all terms related to duration, payment schedules, late fees, security deposits, and specific usage conditions, is a separate, private legal contract solely between the Lessor and the Hirer.
- Off-Platform Management: “TheTrailerGuys.uk” does not manage, process, or hold any rental payments, security deposits, or damage waiver fees. All financial and contractual details are handled exclusively between the Lessor and the Hirer.
- No Dispute Resolution: You agree that “we” are not responsible for enforcing the rental contract, resolving disputes related to late returns, damage claims, or the return of deposits.
4. Terms for Service and Training Listings (Business Promotion)
This section applies to all businesses or individuals (the “Advertiser“) promoting their professional services, products, or training courses on “our” website.
4.1. Advertiser Qualifications and Content
When posting a Service or Training listing, the Advertiser warrants and agrees to the following:
- Legal Compliance: The Advertiser is duly registered, licensed, and certified (where applicable) to legally offer the advertised services or training within the specified geographic area.
- Accuracy of Promotion: All content, including business descriptions, service pricing, hourly rates, accreditation claims, and training prerequisites, must be accurate, current, and verifiable. Listings must not contain misleading or fraudulent claims about quality, expertise, or pricing.
- Intellectual Property (IP): The Advertiser guarantees that all images, logos, text, and other material provided for the listing do not infringe upon the IP rights, copyrights, or trademarks of any third party. The Advertiser grants “TheTrailerGuys.uk” a non-exclusive, royalty-free license to use, reproduce, and publish this content on “our” website.
- Insurance: The Advertiser must maintain all necessary business insurance, liability coverage, and professional indemnity insurance required to operate their business and perform the advertised services or training.
4.2. Platform Role and Limited Liability
- No Vetting: “TheTrailerGuys.uk” does not independently verify the professional qualifications, insurance status, or operational integrity of any Advertiser. We are not an accreditation or licensing body.
- Customer Due Diligence: Users seeking services or training are solely responsible for conducting their own research, verifying credentials, checking references, and evaluating the quality of the Advertiser before entering into a contract.
- Off-Platform Contract: Any agreement, warranty, or contractual obligation related to the provision of the service or training (e.g., trailer repair warranty, course completion certificate, service payment terms) is formed exclusively between the Advertiser and the Customer/Delegate. “We” have no liability or involvement in the outcome of these contracts.
- Disputes: “We” are not responsible for resolving disputes regarding service quality, billing errors, or contractual breaches between the Advertiser and their customer.
4.3. Financial and Listing Terms (Paid Promotions)
- Payment to Platform: All fees paid by the Advertiser to “TheTrailerGuys.uk” for promotional services (e.g., banner ads, premium listings, subscription packages) are solely for the provision of advertising space.
- Non-Refundable: All advertising and subscription fees paid to us are non-refundable once the content has been published, unless the non-publication is due to our direct error.
- Termination: “We” reserve the right to immediately suspend or terminate an Advertiser’s listing and account, without refund, if we receive credible reports or evidence that the Advertiser is operating illegally, fraudulently, or in serious breach of these T&Cs.
5. Terms for Hire Listings (Trailer Rental and Equipment)
(Sections 3.1 and 3.3 for the Lessor and the Rental Contract remain the same as previously drafted, but the focus below is exclusively on the Hirer’s duties.)
5.1. Hirer Responsibilities and Liability
When you respond to a Hire listing and agree to rent an item (the “Hirer“), you warrant and agree to the following conditions:
- Towing Compliance: You possess the necessary legal driving license and towing entitlements required in your jurisdiction. Your tow vehicle must have sufficient legal capacity and the correct fitting to safely and legally tow the specific trailer listed.
- Safety and Inspection: You are responsible for conducting a thorough, pre-rental safety inspection of the trailer and its connections (lights, tires, coupling, etc.) before taking possession. Your decision to hire the trailer confirms you accept it is in suitable condition for your intended use.
- Care and Proper Use: You agree to treat the item with reasonable care and diligence, using it only for its intended purpose and within any specific restrictions defined by the Lessor. You must not permit the trailer to be operated by unauthorized or unlicensed individuals.
- Damage and Loss Liability: You acknowledge that liability for any damage, loss, or theft of the trailer that occurs from the moment you take possession until it is formally returned to the Lessor rests solely with you, the Hirer. You are liable for the cost of repairs or replacement as determined by the separate rental contract with the Lessor.
- Insurance: You are responsible for ensuring you have adequate insurance coverage (either through your own policy, the Lessor’s policy, or a third-party waiver) to cover potential liabilities, damages, or losses during the rental period.
- Compliance with Rental Terms: You must strictly adhere to the specific terms set out in the Lessor’s rental contract, including:
- Returning the trailer on time to the agreed-upon location.
- Paying all rental fees, late return fees, cleaning charges, and any loss of security deposit directly to the Lessor.
6. General Provisions, Indemnity, and Governing Law
This section contains the fundamental legal terms that govern your relationship with “TheTrailerGuys.uk” and apply to all users across all sections of the Service.
6.1. Disclaimers of Warranties
- “AS IS” Basis: The Service is provided on an “AS IS” and “AS AVAILABLE” basis. “We” expressly disclaim all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
- No Guarantee of Service: “We” do not warrant that the Service will be secure, uninterrupted, error-free, timely, or that any defects or errors will be corrected. We are not responsible for any technical failure or internet connectivity issues that may result in the loss of data or the failure of a listing to appear.
- Reliance on Content: “We” do not warrant or make any representations regarding the use or the results of the use of the content or materials available on “this “our” website, including the accuracy or reliability of any listings for trailers, services, or training.
6.2. Limitation of Liability
- Exclusion of Damages: To the maximum extent permitted by applicable law, “TheTrailerGuys.uk” (including its owners, directors, and agents) shall not be liable for any indirect, incidental, special, punitive, exemplary, or consequential damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses.
- Transaction Limit: In no event shall our total liability to you for all damages, losses, and causes of action exceed the greater of: (i) the total amount of fees paid by you to “TheTrailerGuys.uk” for the use of the Service in the twelve (12) months preceding the claim.
- Basis of the Bargain: You acknowledge that the pricing and commercial terms offered by us reflect the allocation of risk and the limitation of liability set forth in this section, and that these limitations are an essential basis of the bargain between you and us.
6.3. Indemnification
You agree to defend, indemnify, and hold harmless “TheTrailerGuys.uk” and its affiliates, officers, directors, agents, and employees from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt (including but not limited to legal fees) arising from:
- Your use of and access to the Service.
- Your breach of any term of these T&Cs.
- Your violation of any third-party right, including without limitation any copyright, property, or privacy right.
- Any claim that your User Content (listings, reviews, etc.) caused damage to a third party.
- Any transaction or dispute arising from a Sale, Hire, Service, or Training contract initiated through the Service.
6.4. Governing Law and Dispute Resolution
- Governing Law: These Terms shall be governed and construed in accordance with the laws of England, Wales and Scotland, without regard to its conflict of law provisions.
- Jurisdiction: You agree that any legal action or proceedings arising out of or relating to these T&Cs shall be submitted to the exclusive jurisdiction of the courts located in Newcastle Upon Tyne, UK.
- Time Limit for Claims: You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or these T&Cs must be filed within one (1) year after such claim or cause of action arose or be forever barred.
